1. Scope of this Agreement
This Agreement defines the contractual relationship between Atropi Ltd (“the Company”, “we”, “our”) and the individual or corporate client (“the Client”, “you”).
By opening and maintaining a trading account with us, you acknowledge that you have read, understood, and agreed to all provisions contained herein.
2. Company Information
Atropi Ltd operates under the trading name ATROPI.
Registered Firm No: HY01223067
Licensed and regulated by the Mwali International Service Authority.
Our registered office and contact information are published on our official website.
3. Nature of Business
Atropi Ltd is a fully authorized forex and CFD brokerage offering access to currency pairs, commodities, indices, and options.
We provide both proprietary and third-party trading platforms, including MetaTrader 5 and MetaTrader 5 Mobile.
Execution is strictly on an execution-only basis; we do not provide investment advice.
All market data and BID-ASK prices are aggregated from reputable liquidity providers and interbank sources.
4. Trading Accounts
4.1 Account Opening
To trade, you must complete registration and open an Active Account.
Each client may hold only one active account per account type or currency class.
Duplicate or unauthorized accounts may be closed at our discretion.
4.2 Know Your Customer (KYC) and Verification
You must provide true, current, and complete identification details.
Required documents include:
- Proof of Identity (passport, national ID, or driver’s license)
- Proof of Address (recent utility bill or bank statement issued within 6 months)
Verification must be completed within 15 days of registration.
Failure to comply may result in account suspension or closure.
Any profits, bonuses, or open positions will be managed per the termination clause.
4.3 Account Security
Maintain the confidentiality of your login credentials. Notify us immediately if you suspect unauthorized access.
4.4 Segregated Funds
All client monies are held in segregated accounts at reputable banks and are not commingled with Company funds.
4.5 Currencies & Payments
Accounts operate in the base currency selected at opening.
Accepted payment methods: Bank Transfer, Debit/Credit Card, E-Wallets, Cryptocurrency.
We accept only cleared funds.
4.6 Deposits and Withdrawals
- Withdrawals require prior identity verification.
- Refunds to cards will not exceed the original deposit amount.
- Bank transfer withdrawals may be subject to additional banking or currency-conversion fees.
- Deposits must originate from accounts held in your own name, in compliance with AML regulations.
- E-wallet or crypto deposits are credited net of processing fees.
- The Company may restrict or limit deposit amounts or methods at its discretion.
4.7 Rolling Fees / Swaps
Positions held overnight may incur a Swap or Rolling Fee, automatically debited from your free balance.
Insufficient funds may result in position closure.
4.8 Islamic Accounts
Clients observing Islamic principles may request a Swap-Free (Islamic) account.
Abuse of this privilege allows the Company to revoke the status or close positions.
4.9 Dormant Accounts
Accounts inactive for 3 consecutive months may be deemed dormant and charged a maintenance fee of USD 25 or the remaining balance, whichever is lower.
4.10 Order Execution
We take all reasonable steps to achieve best execution, in accordance with our Order Execution Policy, available on our website.
5. Marketing and Promotions
Promotional campaigns may be offered periodically.
Each campaign carries specific terms and conditions.
Participation implies acceptance of those terms.
6. Termination
Either party may terminate this Agreement upon written notice.
Immediate termination may occur in cases of:
- Fraud, misrepresentation, or unauthorized activity
- System tampering or abuse
- Non-payment or regulatory restriction
Upon termination, open positions will be closed at current market rates.
7. Unauthorized Activities
Clients must not engage in any of the following:
- Money laundering or fund concealment
- Arbitrage or latency exploitation
- Submitting false documents
- Hedging in bad faith or off-market trading
- Use of excessive leverage leading to negative balances
- Churning (excessive trading to generate commissions)
- News gap or break gap abuse
- Operating multiple accounts for manipulative purposes
Breaches may result in immediate suspension, closure of positions, and confiscation or return of funds.
8. Intellectual Property
All intellectual property related to Atropi platforms, software, trademarks, and materials remains the exclusive property of Atropi Ltd.
Unauthorized copying, modification, or reverse engineering is strictly prohibited.
9. License to Use the Platform
You receive a non-exclusive, non-transferable right to access our trading platforms solely for trading purposes.
You may not reproduce, resell, or distribute any part of the system or data without written authorization.
10. Limitation of Liability
Services are provided electronically on an “as-is” basis.
We are not liable for interruptions caused by:
internet failures, hardware errors, power outages, or third-party service disruptions.
Under no circumstances shall Atropi Ltd be liable for indirect, incidental, or consequential losses.
11. Indemnity
You agree to indemnify and hold the Company harmless against any claims, losses, or expenses resulting from your breach of this Agreement.
Our total liability is limited to the amount held in your trading account at the time the issue arises.
12. Risk Disclosure
Trading leveraged products involves significant risk.
You may lose all invested capital.
Only trade with funds you can afford to lose and ensure you understand the risks associated with Forex and CFD trading.
By opening an account, you acknowledge receipt and understanding of our Risk Disclosure Statement.
13. Misquotes and Pricing Errors
Transactions executed on manifest errors or system malfunctions may be corrected or cancelled at the Company’s discretion.
Remedial actions include adjusting entry or exit prices to reflect true market conditions.
14. Suspension of Services
The Company may temporarily suspend or terminate services in the event of extraordinary market conditions, technical failures, or regulatory obligations.
All open positions may be closed at fair market value.
15. Data Protection & Privacy
We adhere to applicable Data Protection and Privacy Laws, including GDPR principles.
Personal information is stored securely and not disclosed to third parties except as required by law or regulatory authority.
Use of our website implies consent to our Privacy Policy and Cookie Policy, available online.
16. External Links and Information
External links on our website are provided for informational purposes only.
Atropi Ltd assumes no liability for third-party content or accuracy.
You are solely responsible for interactions with external sites.
17. Taxation
You are responsible for determining and fulfilling your own tax obligations arising from trading activities.
Atropi Ltd does not provide tax advice or withhold tax on your behalf.
18. Amendments
The Company may amend this Agreement at any time without prior notice.
Continued use of our services after publication of such changes constitutes acceptance of the revised terms.
19. Complaints Handling
If you wish to file a complaint, contact us via the support email provided on our website.
We aim to resolve all matters fairly and promptly in accordance with our Complaints Handling Policy.
20. Trading Hours
Trading is generally available 24 hours a day, Monday 00:01 GMT to Friday 23:59 GMT, except during maintenance or holidays.
Specific product hours may vary based on market conditions and liquidity provider schedules.
21. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including war, acts of God, government restrictions, natural disasters, or communication failures.
22. Communications and Recordings
All telephone calls and electronic communications may be recorded for compliance, dispute resolution, and service-quality purposes.
By entering this Agreement, you consent to such recordings.
23. Entire Agreement
This Agreement supersedes all prior understandings or communications.
The latest version published on our website always prevails.
24. Conflict of Interest
The Company maintains a comprehensive Conflicts of Interest Policy to ensure clients are treated fairly.
You acknowledge that you have read and accepted this policy.
25. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the Union of the Comoros.
Disputes will first be handled amicably through your account manager.
Unresolved disputes shall be referred to arbitration under Comorian law, with an arbitrator jointly appointed by both parties.
Section 26 — Platinum Account Terms
26. Platinum Account Terms
These terms apply exclusively to Platinum Account holders. By opening or maintaining a Platinum Account, the Client agrees to the following:
26.1 Execution Speed & Scalping Restrictions
- The Platinum Account provides ultra-fast execution speeds of up to 20 milliseconds.
- Any form of high-frequency scalping is strictly prohibited.
- If more than 2% of the Client’s total trading volume consists of positions held for less than 5 minutes, the Company may classify this activity as a violation of trading rules.
- In such cases, the Company reserves the right to:
- Withhold or delay withdrawals
- Apply restrictions
- Reassess the Client’s trading status
- Suspend or terminate the account if necessary
26.2 Swap-Free Conditions & Abuse Prevention
- The Platinum Account operates under swap-free conditions.
- Any attempt to exploit rollover advantages or perform artificial overnight strategies is strictly prohibited.
- The Company may intervene, restrict, reverse, or adjust any transactions identified as swap-abusive behavior.
26.3 Bonus Policy & Abuse
If removing the bonus results in margin issues, stopped-out positions, or trading disruptions, the Company bears no responsibility for resulting losses.
The Platinum Account provides a 30% trading bonus, up to a maximum of USD 3,000.
Any form of bonus manipulation or abuse will result in immediate removal of the bonus at the Company’s sole discretion.
26.4 Free Margin Utilization & Compliance Monitoring
If more than 60% of the Client’s free margin is consistently used in a single directional exposure, the account may be classified as high-risk, suspicious, or potentially involved in unjustified trading behavior, including but not limited to money-laundering patterns or abnormal exposure strategies.
• Due to the absence of dynamic leverage—offered intentionally to provide Clients with unrestricted trading freedom while maintaining non-aggressive behavior—the Broker reserves the full right to review, limit, or adjust any profits derived from such trading activity.
• At the time of withdrawal, the Client’s trading activity will undergo a compliance review.
• If violations, abusive behavior, or non-compliant exposure patterns are detected, the Broker may apply corrective actions, which may include:
• Adjusting or canceling profits
• Rejecting or delaying withdrawals
• Requiring additional verification
• Imposing trading restrictions
• Terminating the account if necessary
